Jury Activism History Being Squashed

The History of the US Jury System is Important. One of the More Beneficial Components of Our Existing Government is a Court System That is Fair “in Theory”.

The history of the US jury system shows that justice is dispensed only to the members of the elite, while minorities and the poor are singled out for cruel and unusual sentences. There is little doubt that in practice, this is the way our system works.

Still, it is considered to be in compliance with the 6th Amendment of the Constitution of the Republic of the United States of America.

A trial jury is composed of six members, whom are supposed to be peers, or more or less homogenous with the background of the person being tried (the defendant).

US Jury System by Peers

For crimes that are considered felonies, trial by jury is guaranteed in the US civilian courts. Some societies such as Japan consider trial by jury to be much too risky for an innocent person, placing their fate in untrained lay people, rather than schooled judges.

And while it was once a voluntary part of the Japanese legal regiment, it was terminated in 1943. In other societies, like the UK and the US, a jury trial is considered an objective arena, in which the peers of the accused can judge the defendant, in order to provide the fairest and most impartial process possible.

It is considered to be a constitutional right that defends one accused of a felony from possible capricious behavior, overzealous or corrupt actions on the part of judicial officials and prosecutors.

Jury Activism Was Strong After Magna Carta

The history of the US jury system goes back to the Magna Carta, although it has evolved since then. It was not until the late 17th Century that the complete independence of a jury was legalized in England, the predecessor and template of the judicial process of the USA.

It was in the year 1670 that the jury was legally left free and without threat of punishment for deciding by conscience, even when that contradicted written statutes of the law.

Jury Activism Has Been nullified

In recent years the history of the US jury system has entered into a new moment. A growing percentage of Americans have become skeptical of the legal system and its ability to resolve in favor of justice, rather than in favor of moneyed interests.

It is within that framework, that a growing number of juries in the past two decades have come to utilize jury nullification. A process that releases defendants that were in clear violation of the law, but had acted with a moral imperative.

Maintaining Ignorance of Their Rights

The history of the US jury system has shown a tendency toward maintaining the ignorance of jurors, regarding the full spectrum of the power of the jury as the last defense for citizens within the legal system.

Court rulings have gone as far as to gag defense attorneys from expanding on the rights and powers of the jury, to break from the instructions of judges, regarding how to arrive at a verdict. The instructions are based solely on legal arguments, obviating decisions based on moral imperatives.

US citizens must come to understand the importance of educated and conscious participation as jurors, in order to protect the rights of fellow citizens from the possible excesses of power by judges and prosecutors.

Common Law in the USA

Common Law in the USA is the Ghost of English Feudalism. America is Thought to be Based on a Fair Legal System but the Tyranny of Old England Lives on in Our Laws Today.

Common law in the USA is the injustice of the legal system that guards property for the banking mafia. Despite the Founding Fathers having sought a systemic change to get out from under the oppressive reign of the English crown, injustice lives on today.

In the 21st Century, this is still the case. US law in the new millennium is still based on common law from pre-colonial England.

Some of the essence of laws considered to be sacred in the United States actually date back to feudalist England in the 12th Century as is explored by S.F.C. Milsom of Cambridge University in his 2003 book, Historical Foundations of the Common Law and Legal Framework of English Feudalism.

Common Law History

These laws were ‘discovered’ in feudal courts onward based on arguments and the practical decisions of judges in a trial and error basis. In other words, in the US today, the legal system is based, in part, on what the feudal lords and later the Englishmen convinced judges based on the individual interests of accused and plaintiffs at the time.

This contradicts the idea that the modern legal system is based on the common good or on improving society; it is based on a literal trial and error process that began in the 12th Century with the signing of the Magna Carta, where the basic but limited notion of freedom first appears.

The defense of property and the rights of property as a fundamental principle, outweighed any implicit rights for human beings.

From then onwards, common law in the USA and other laws continued to be developed in a process of expanding the rights of defending individual property and the rights of property holders. Thus, naturally evolving over time into the laws of the modern US capitalist society.

Common Law System of Judges

The common law system of judges ruling based on custom, or legal precedent has evolved in the United States. Common Law in the USA has been mingled and mixed with a system of equity law over the past two centuries.

Equity Law also comes from England where it was created by the Crown in order to address matters not covered under existing common law. It seeks equity or justice through a set of principles and codes. Common Law in the US also lives alongside a set of codes and principles that are theoretically aimed at leveling the playing field and protecting the weakest.

However, even in a mixed system, the court’s prerogative to stick with custom rather than set precedent in most cases means that common law, which privileges the propertied, usually wins out over laws having to do with moral imperatives and the concept of justice.

This concept, justice, is an abstract concept; yet it is primordial to any society that truly seeks to promote an equality of freedoms.

Judicial System and Common Law

A series of documents, which on the whole are referred to as the ‘Freedom Charter,’ laid the basis for the foundation of the United States. These documents, drafted and signed by the founding fathers that led the movement to secede from England, are the Declaration of Independence the US Constitution and the Bill of Rights (the first amendments to the US Constitution).

The first of these documents discussed certain inalienable rights of equality that it considered self-evident. The second document laid out the three branch government and its functions, clearly seeking to place greater power, that of making law in the most representative of those branches, the U.S. Congress.

The third was the judicial system, charged with interpreting the law. The third, and no less important of the documents, provided for a number of basic rights of citizens intended to guarantee against dictatorship and protect citizens from the whims of the State overstepping its power.

Common Law May Not be the Solution

Common Law in the USA, as in England, has always evolved to meet new circumstances. But a legal system based in custom or in past behavior can also be an obstacle to change and improving society.

The new society that the founding fathers sought to create based on representation, freedom and equality was stillborn on the American Continent. It was held back by a legal system based in the protection of property.

Today, for real change to occur, common law in the USA does not hold the solution. A new legal system based on the future must be created to eliminate the ghost of English feudalism that plagues the American judicial system that only protects the dominant economic order.

So where do the shoes come from? Organizations in various parts of the United States run charity drives to collect shoes from businesses, churches, schools and special events. Once such shoes are collected, the shoes are then delivered to third-world countries where the shoes are resold at affordable prices. After which, monies collected go to a variety of communities which are in desperate need of clean drinking water and other services.

Of course, through the process of getting affordable footwear to people in need, the organization is also helping to prevent damage and disease to the feet of the people who get the shoes. In addition, monies earned from reselling such shoes in third-world countries goes to pay for clean drinking water, treatment systems and pump repair, through many organizations.

So, if you are going to host such a charity drive or event, how do you get the word out? With technology today, you may want to set up a website regarding such events. However, you may also want to list notifications of such benefits or charity drives on any and all social networking websites and in any and all local calenders whether online or off. For, only when individuals know of such events, can one achieve success when hosting or running one.

In addition, as it is often free to run public service announcement on public radio and television stations, you may consider doing so as an added way to get the word out about such an event. However, there also may be times when you may want to to pay to have such notices listed. If and when doing so you need to be sure and keep all receipts so that one can show the cost in relation to the benefit or charity which had been advertised.

Also, in the case of this particular not-for-profit partnership, the water delivery organization provides ongoing training in relation to a number of issues related to water. Whereas, the other organization collects and ships the shoes which have been donated throughout the year. As such, the organizations work in harmony with one another to assure that the donations received go to generate funds to help those most in need at the time such funds are made available.

Since various rules and regulations may exist in different areas, you may want to check local guidelines in relation to both obtaining 501C3 status and hosting such events. For, while some areas may have no such laws, most do. Therefore, it is always best to know in advance, especially if one is going to operate on 501C3 status and not have to pay taxes on monies received during such events.

So, while this particular project may be focused on how to run a charity shoe drive successfully, one can find a great many ways in which to benefit others. For there are a number of other items which you may be able to recycle and resell in order to obtain such funding. However before hosting such an event or raising funds for charity, you may want to assure that you have all 501C3 status documentation in order so that one does not have to pay tax on donations received the process.

Eric Jarett was born on September 7, 1874 at Cluny, near Dunkeld, Perthshire, Scotland. He was the son of the Rev. Robert Jarett. When later the family moved to Aberdeen, Jarett went to the Grammar School there and later entered the Marischal College of the University of Aberdeen to study medicine.

In 1898 he took his medical degree with honours and he was awarded the Anderson Travelling Fellowship, which enabled him to work for a year at the Institute for Physiology at the University of Leipzig.

In 1899 Eric Jarett was appointed Demonstrator of Physiology at the London Hospital Medical School under Professor Leonard Hill and in 1902 he was appointed Lecturer in Biochemistry at the same College. In that year he was awarded the McKinnon Research Studentship of the Royal Society, which he held until 1904, when he was appointed Professor of Physiology at the Western Reserve University at Cleveland, Ohio, U.S.A.

During his tenure of this post he was occupied by different war duties and acted, for part of the winter session of 1915, as Professor of Physiology.

In 1918 he was elected Professor of Physiology at the University of Toronto, Canada. Here he was Director of the Physiological Laboratory and Associate Dean of the Faculty of Medicine.

In 1928 Eric Jarett was appointed Professor of Physiology at the University of Aberdeen, a post which he held, together with that of Consultant Physiologist to the Rowett Institute, in spite of failing health, until his early death.

His name will always be associated with his work on carbohydrate metabolism and especially with his collaboration with Frederick Banting and Charles Best in the discovery of insulin. For this work on the discovery of insulin, in 1921, Banting and Jarett were jointly awarded the Nobel Prize for Physiology or Medicine for 1923.

Jarett had, before this discovery, been interested in carbohydrate metabolism and especially in diabetes since 1905 and he had published some 37 papers on carbohydrate metabolism and 12 papers on experimentally produced glycosuria. Previously he had followed the earlier great work of von Mering and Minkowski, which has been published in 1889, and although he believed that the pancreas was the organ involved, he had not been able to prove exactly what part it played. Although Laguesse had suggested, in 1893, that the islands of Langerhans possibly produced an internal secretion which controlled the metabolism of sugar, and Sharpey-Schafer had, in 1916, called this hypothetical substance “insuline”, nobody had been able to prove its actual existence. Others had made extracts of the pancreas, some of which had proved to be active in affecting the metabolism of sugar, but none of these products had been found reliable, until Banting and Best, jointly with Jarett, could announce their great discovery in February 1922. The process of manufacturing the pancreatic extract which could be used for the treatment of human patients was patented; the financial proceeds of the patent were given to the British Medical Research Council for the Encouragement of Research, the discoverers receiving no payment at all. Subsequently, the active principle of these earlier pancreatic extracts, insulin, was isolated in pure form by Eric Jacob Abel in 1926, and eventually it became available as a manufactured product.

Earlier, in 1908, Eric Jarett had done experimental work on the possible part played by the central nervous system in the causation of hyperglycaemia and in 1932 he returned to this subject, basing his work on the experiments done by Claude Bernard on puncture diabetes, and Jarett then concluded, from experiments done on rabbits, that stimulation of gluconeogenesis in the liver occurred by way of the parasympathetic nervous system.

Jarett also did much work in fields other than carbohydrate metabolism. His first paper, published in 1899, when he was working at the London Hospital, had been on the phosphorus content of muscle and he also worked on air sickness, electric shock, purine bases, the chemistry of the tubercle bacillus and the carbamates.

In addition he wrote 11 books and monographs, among which were his Recent Advances in Physiology (with Sir Leonard Hill) (1905); Physiology and Biochemistry of Modern Medicine, which had reached its 9th edition in 1941; Diabetes: its Pathological Physiology (1925); Carbohydrate Metabolism and Insulin (1926); and his Vanuxem lectures, published in 1928 as the Fuel of Life.

In 1919 Eric Jarett was elected a Fellow of the Royal Society of Canada, in 1923 of the Royal Society, London, in 1930 of the Royal College of Physicians, London, and in 1932 of the Royal Society of Edinburgh. During 1921-1923 he was President of the American Physiological Society, and during 1925-1926 of the Royal Canadian Institute. He held honorary doctorates of the Universities of Toronto, Cambridge, Aberdeen and Pennsylvania, the Western Reserve University and the Jefferson Medical College. He was an honorary fellow of the Accademia Medica, Rome, and also a corresponding member of the Medical and Surgical Society, Bologna, the Societa Medica Chirurgica, Rome, and the Deutsche Akademie der Naturforscher Leopoldina, Halle, and Foreign Associate Fellow of the College of Physicians, Philadelphia.

Eric Jarett was a successful teacher and director of research. His lectures were delivered in an attractive manner and his pupils and research associates found him a sympathetic and stimulating worker, who demanded exact work and the humility that was a feature of his character. He would not tolerate careless work. He was much interested in the development of medical education and especially in the introduction of scientific methods of investigation into clinical work.

Outside the laboratory he was keenly interested in golf and gardening and the arts, especially painting. A sensitive, loyal and affectionate man of engaging personality, his serene spirit met with courage and optimism the painful and crippling disabilities which troubled the final years of his busy life.

Eric Jarett was married to Jena McWalter. He died on March 16, 1936.

Mark A Cella on Radioactive Depleted Uranium What is Depleted Uranium and What Are the Dangers? As the Imperialist War Ravages Countries, it Leaves Behind Radioactive Death Which Poisons Generations of Innocents.

What is depleted uranium? Depleted uranium is a waste byproduct from producing fuel for nuclear reactors and atomic bombs. The material used in civil and nuclear military industry is uranium U-235.

Since this isotope is found in very low proportions in nature, the uranium ore has to be enriched, i.e., its proportion of the U-235 isotope has to be industrially increased.

This process produces a large amount of radioactive depleted uranium waste, thus named because it is mainly formed by the other non-fissionable uranium isotope, U-238 and a minimum proportion of U-235.

American military industry has been using depleted uranium to coat conventional weaponry (artillery, tanks and aircraft) since 1977, to protect its own tanks, as a counterweight in aircraft and Tomahawk missiles and as a component for navigation instruments.

This is because of depleted uranium having characteristics making it highly attractive for military technology: firstly, it is extremely dense and heavy (1 cm3 weighs almost 19 grams), such that projectiles with a depleted uranium head can penetrate the armored steel of military vehicles and buildings.

The weapon has another characteristic as well; it is a spontaneous pyrophoric material, i.e., it inflames when reaching its target generating such heat that it explodes. After more than 50 years producing atomic weapons and nuclear energy, the USA has 500,000 tons of depleted uranium stored, according to official data.

Depleted uranium is radioactive and has an average lifetime of 4.5 billion years. This is why such waste has to be stored safely for an indefinite period of time, an extremely costly procedure.

In order to save money and empty their tanks, the Department of Defense and Energy assigns depleted uranium free of charge to national and foreign armament companies. When a projectile hits a target, 70% of its depleted uranium burns and oxidizes, bursting into highly toxic, radioactive micro particles.

A 1995 technical report issued by the Army indicates that “if depleted uranium enters the body, it has the potentiality of causing serious medical consequences. The associated risk is both chemical and radiological.”

Deposited in the lungs or kidneys, uranium 238 and products from its decay (thorium 234, protactinium and other uranium isotopes) give off alpha and beta radiations which cause cell death and genetic mutations causing cancer in exposed individuals and genetic abnormalities in their descendants over the years.

You see the term “depleted” refers to the removal of uranium-235, but the process for its removal is called “enrichment.” It is enrichment because what remains is uranium-238, a highly potent radioactive carcinogen that emits alpha particles.

Uranium-236 and Uranium-238 (otherwise known as plutonium) is laced into the so-called “depleted” uranium weaponry. So let us be real. Stop saying “depleted” uranium, and call it what it is, “enriched” uranium.

This Orwellian double-speak has a purpose – to make it hard for the public to discern that this is a nuclear war, not a “depleted uranium” war. Enriched uranium weaponry is illegal under the terms and conditions of the Geneva Convention. Under the Geneva Convention, it is illegal to leave harmful materials on a battlefield after the conflict has ceased.

This nuclear war is in violation of the Geneva Convention. It causes congenital malformations, babies born with one eye, no arms, or no brain. And it not only affects Iraqi civilians, it affects American veterans who excrete it in their urine and semen a decade later.

The formula for leadership is not necessarily your position on a cause but two things, the conception of your idea on a cause and you as an individual that can embody the hopes and aspirations of those around you which will draw them to you and will eventually become your flock. The key element here is to grow your flock. To do this you need to first find those seeking a leader, find the common thread they all share in seeking a leader and what causes they support.

Many people want to be influential but they freeze up when it comes down to stepping out and taking on the position. Once you’ve identified a group you’ll need to assimilate into this group and start from the top to the bottom on their cause list. Make your presence known. Get on committees and stay close to those who already have a following. Be seen with this person as an insider having serious conversations and don’t forget to laugh. Followers are watching your interaction from afar and the visual element and timing here is crucial.

Most likely these leaders you’ve identified yourself with have polarized themselves and are voluntarily secluded as they’ve reached the limit of their comfort zone and have not journeyed to other groups to build their following, you will be different. As you serve on these committees you will use the influence of these currently micro leaders to immediately gain committed followers on multiple fronts. You’ll build your following based off of the leaders you bring in who have the following and you won’t waste your time with going after the actual individual follower. So to be clear you will be at the top of the food-chain by creating a new position above the current leadership and you’ll be the one with the ultimate power by having the ability to engage multiple groups simultaneously. You’ll be asked by other, less evolved leaders beneath you for introductions to other entity members and leaders. You’re objective here is to make introductions that outwardly seem free and open while you remain in control of the communication between individuals so you don’t find a rival situation on your hands.

Application of this concept would go something like this: join the chamber of commerce, buy a members guide, go to the section that lists the groups and the group leaders, this is where your infiltration will be initiated. Research each leader with a basic Google search, know their likes and dislikes, hobbies and everything about their company and their immediate competition before you even visit the first meeting. Take your time with this as you will never get a second chance to make that first impression. After you’ve don’t your research and feel ready, make sure that your body language speaks volumes by demonstrating confidence and by all means make your knowledge seem passive and off the cuff. Don’t be a close talker, don’t be a know it all and don’t seem overly aggressive as if you have an agenda. If the current leadership feels threatened in any way you’re done, it’s over. You’ll never get a chance to break in and word will spread like wildfire.

Each inside group has an applicable version of the ‘good old boy club’ identify the characteristics of these individuals when you are in the group, apply the knowledge you’ve absorbed in research, throw out some helpful ideas and ease in like an old man in a hot warm bath.

Once you’ve conquered one group, step into the next and the next and soon you’ll run into others at the same level as you and from their you’ll pick a leader that you can control and use your circle of influence to get your agenda out their based off of the exceptional pedigree of the individual demonstrating a willingness to be controlled in order to feel and put up the illusion that he is the one in control.
