San Jose DWI Lawyer Helps Those Who Are Charged With Drunk Driving

March 10, 2010 at 2:09 am • Posted in PoliticsComments Off

A San Jose DWI lawyer will be the person you need to call if you have been arrested for drunk driving. If you failed the field sobriety test and are taken to the station and then fail the breath test or the blood or urine test then you will be charged with the offense.

If the officer thinks you did not pass according to his subjective observation you will be arrested and taken to the police station. You car or truck will be impounded. At the police station you will go through an alcohol testing.

This does not mean you are actually safe to drive at any level of alcohol but there has to be a legal limit set. It is unclear how much alcohol affects a particular person. But the bottom line is that to drink and drive is an irresponsible act. The person drinking and then driving can injure himself and others and also kill on the road.

The public has made such a complaint that the laws affecting the drunk driver suspect are very strict. In many cases he or she will not have the rights others do in other criminal proceedings.

This is not to say that a person who is actually guilty of the offense should escape punishment but people are still innocent until proven guilty even those who are suspected of driving while under the influence. If you are pulled over and you do not agree to the field sobriety test you are subject to arrest.

If you refuse to take the field sobriety test you will be arrested for failure to comply with the officer’s instructions and not for drunk driving. It will be at the station you will have to take the alcohol test. If your breath, urine, or blood test does not show your above the legal limit you will be let go.

If you are facing DWI charges in SJ, you need to discuss your options with an experienced Sunnyvale DWI Lawyer.

Private Placement Memorandum and OTCBB: How to Make Investors Come Out of The Woodwork

March 3, 2010 at 2:43 am • Posted in PoliticsComments Off

If you are trying to raise capital with a PPM or public entity like OTCBB you need to understand the mind of the investor. After the business plan sells the investor on the business concept you need to sell them on you and your executive staff. You need to stack your executive positions with professionals with a proven track record of success and possess a solid reputation in the industry. You must paint the picture for investors that your business is run by the who’s who in your industry and this pedigree is demonstrated by your education, degree, grades in college, professional organizations of which you have been and are currently a member, advisory board positions with other corporate organizations, a track record of setting up and maintaining strategic alliances, networking contacts and more.

When an investor looks at your human resource list on your PPM, business plan or public offering docs it needs to scream power, authority and confidence. Each individual that you place on your advisory board must have a massive contribution other than ‘advice’. Advisors should be able to prove their ability to assist in crucial decisions, connect your company with strategic partners and help you get to the next level.

Your legal counsel and CPA should be well known organizations with a long list of successful, well known organizations on their client roster and they should have a lot more to offer your company than just their fee based services. Again, these organizations should be able to set you up with partnerships that will help grow your business. As far as corporate awareness you must include a publicist. The publicist that you choose must be well versed in their comprehension of your industry genre.

They must be able to take your company and get you in front of the proper audience that is conducive to enhancing your growth potential. They must be able to demonstrate their knowledge of viral online marketing as well as traditional means of radio, TV and article promotion. They should be able to reach into their contact list and set you up with one interview after another targeting your specific audience.

These are just a few things to take into consideration when you jump on the fund raising trail. Every individual you have listed on your docs must be able to pass due diligence and have the appeal that reaches into the ‘comfort’ zone portion of the investor’s mind.

Gold Wedding Rings

March 2, 2010 at 11:55 am • Posted in PoliticsComments Off

The most frequently used element for wedding rings and engagement rings is gold. White gold is even more exclusive. Gold wedding rings look good whether the design is just a straightforward, plain band or an engraved band like a Celtic Knot. Gold rings can be given on other occasions as well of course. Some people give their children a gold ring for their coming of age birthday.

Until not so long ago, it was customary for the man to give a gold ring when he asked for his girlfriend’s hand in matrimony. However, nowadays it is more usual for the couple to go shopping for the engagement or wedding ring together. This makes good sense, even if it is less romantic, because the wearer can get the design that she likes.

Gold symbolizes purity in many cultures and that is one of the reasons why it is given to brides and brides to be. The symbolism is all but lost though in today’s consumer society in the West. For many people though it still symbolizes the hope that they will stay true to each other, until the day they die. It is a way of showing that the wearer has taken vows and intends to stick to them.

There is a vast variety of gold rings available. However, the variety lies not only in the design but also in the purity of the gold. Logically, the purer the gold, the more expensive it is. In the UK, most gold rings are either 9 or 18 carat. In the USA, most gold rings are 14 carat, but in Thailand, few people would buy gold that is less than 18 carat and 22 carat is the norm for women. Pure gold is 24 carat, however pure gold is so malleable that you can mould it with your bare hands.

This might sound fine, but it is not. A 24 carat gold ring goes out of shape every few hours, just by you doing what you do every day and then it can pinch your skin. Opening a door can buckle the ring. This means that you can not set stones in pure gold, because they would soon fall out. Pure gold rings are best not even engraved because the design would soon rub off.

Therefore, the best place to begin, if you want a gold ring, is to think about what style you want. Do you want precious stones set into it? Then you should not really go above 18 carat. If you cannot afford 18 carat then 9 or 14 carat is for you. If you want something like a Celtic Knot ring, that is one with an engraved design, then anything up to 18 carat for you too, depending on your budget. If you want a pain band of gold, then a thick ring of 22 carat gold would be great, but not if you do a lot of manual work.

If you really want something special, why not have a gold ring made to your own design? It is not so expensive as you might think and you will end up with something unique, especially if you provide your own stone to be polished too. Such a gold ring would become a family heirloom and could stay in the family for centuries.

Fire Insurance Pays for New Furniture Store, But Not New Customers

March 1, 2010 at 11:33 am • Posted in PoliticsComments Off

Fire destroyed a Torrance furniture store, just outside of Los Angeles, in 2004. The three-alarm fire, which required 49 firefighters to put out the flames, burned designer chairs down to their springs and even caused the roof to collapse. A beautiful, state-of-the-art furniture showroom quickly turned in to a hideous eye sore!

The cause of the fire? Arson. Did insurance pay to re-build the furniture store? Fortunately, yes! But how much business would be lost as a result of this furniture store having to relocate while their charred furniture store was being re-built? Why can’t the fire insurance company cover the potential-loss-of-business too? I would guess that the cost for a new furniture showroom would only be a fraction of the cost of loss that this business incurred as a result of the fire.

It seems that insurance should take everything in to account, not just the property. This showroom was in a prime location on Sepulveda Blvd. in Torrance. What happens when Los Angeles residents drive up to a charred pile of rubble? In 2004, there was no such luxury of jumping on the Web via an iPhone to see if they store has relocated. Instead, they probably went to the Ethan Allen that’s a stone’s throw away.

Believe it or not, this furniture store was still in a temporary location in 2006. Contractors were still finishing the re-build of their original showroom – two years later! As if to add salt to the wound, it turns out that the only location they could find was in a strip mall a mile and a half away. Bear in mind, this is a high-end furniture store, not a discount “knock-off” establishment. Who knows how many of their existing customers passed by their old location and assumed they had officially closed their doors?

Fortunately, they’re now back in their original 13,000 sq. ft showroom. It may be state-of-the-art, but where are all the customers? Will this furniture store ever be flourishing like once was back in 2004? Insurance may have paid for a new showroom, but how about getting them to pay for new customers too?

This story, written about a Torrance furniture store, is true and was written by author Justin Verbaggio. The author has no official affiliation with the furniture store; however, he is a long-time customer.

The Ancient Chinese Lunar Calendar

February 28, 2010 at 11:39 am • Posted in PoliticsComments Off

Before their implementation of the Western solar calendar system, the Chinese almost exclusively followed their own lunar calendar for determining the times of planting and harvesting and festival days. Although people in China today use the Western calendar for almost all business, governmental and practical matters of daily life, the old method still serves as the basis for working out numerous recurring holidays. This coexistence of two calendar schemes has long been accepted by the people of China.

However, this does not only apply to China, it also happens in most other Eastern countries, like Thailand, and most Arabic countries.

A lunar month is determined by measuring the period of time required for the moon to finish its full cycle of 29 and a half days, a standard that makes the lunar year a full eleven days shorter than its solar counterpart. This disparity is made up every 19 years by the addition of seven lunar months.

The 12 lunar months are further divided into 24 solar divisions characterized by the four seasons and times of heat and cold, all of which bear a close relationship to the annual cycle of agricultural work.

The Chinese calendar – very much like the Hebrew calendar- is a combination of the solar and lunar calendars in that it attempts to have its years coincide with the tropical year and its months coincide with the synodic months. It is not surprising that a few similarities exist between the Chinese and the Hebrew calendar.

For instance, an ordinary year has 12 months, a leap year has 13 months. An ordinary year has 353, 354, or 355 days, a leap year has 383, 384, or 385 days. When determining what a Chinese year will be like, one needs to make a couple of astronomical calculations.

First of all, you have to work out the dates for the new moons. In these instances, a new Moon is the completely black Moon (that is to say, when the Moon is in conjunction with the Sun), not the first visible crescent, as is used in the Islamic and Hebrew calendars. The date of a new moon is then the first day of a new month.

The reason why the majority of countries which had their own calendars had to drop them in favour of the Western, Julian calendar that we use today, is business. First the British and then the Americans ran international business and they used the Gregorian calendar. Anyone who sought to work with them had to follow suit. This is why national policy often differs from local custom in Third World countries.

The government desires to deal on the International markets, but the ordinary family in the country can not. So, the government took up the Gregorian calendar but the people only pay lip service to it. I live in Thailand and people here do not even use the 24 hour day divided into two halves. Their day has four sections of six hours each and the first part starts at 6AM, not midnight. Therefore, they have four 4 o’clocks a day, for instance but no 7 o’clocks. They are also 543 years ahead of us, although this is more common, for instance in Muslim countries.

Is Gold Too High To Buy?

February 27, 2010 at 9:20 am • Posted in PoliticsComments Off

During the last several years gold as an investment has been doing better than the stock market. You may be wondering whether it is an advantageous idea to pull back a few of your gold investments due to the value of gold reaching some peaks in the the last 6 months or so.

Gold is customarily considered a hedge against uncertainty and the world condition at present is most assuredly uncertain. Gold have never declined to zero and that is something that cannot be said for stocks, many of which have lost incredible valuations. For those owning gold, they must be thankful to have made an investment that has performed so well.

People with money to invest have to make choices that are increasingly tough in this very bad economic environment. It is difficult to find any investment that is truly safe and pays any sort of reasonable return. If you want to put your money in government guaranteed treasury bills or bank certificate of deposits, you are now getting next to nothing in interest. It is also debatable just how safe anything with the government is since it is technically bankrupt.

While gold is seen as safe, at the present high prices, you must be concerned about getting in at the top. For just like stocks, gold has taken huge drops throughout history and that could certainly occur again. And simply because thus far it has always recovered from such drops, that is not a guarantee that the pattern would continue.

Financial advisors will usually tell you to disseminate your money in gold, stocks, and other investments. This obviously helps to safeguard against losing all of your money, should something happen in one area in which you have invested. So don’t be afraid to add gold to your investments while keeping some of your money in other areas as well.

The Economic Stimulus Bill Endangers Our Country

February 26, 2010 at 11:44 am • Posted in PoliticsComments Off

Recently there have been an increasing number of reports concerning scams connected to applications for government grants. There are some reputable companies that charge fees for information on grants, but they are established companies that have been in business for some time. Now there has been increased interest in locating programs, government bureaucrats have started to label them as scams.

The Democratic bill recently passed does not contain stimulus grants from President Obama. Most people do not understand this. There is no financial provision for individual people. Though some programs do indirectly benefit individuals by helping them obtain a new job or offering assistance with their mortgage, there is no legislation guaranteeing them payouts from the government on an individual basis.

The United States is stuck in a very difficult situation. The economy is continuing to fail and the government continues to increase the deficit as if there are no consequences. Obama was elected because people wanted change, however, most people have no clue the trouble the country is truly in. It is true we are getting change. However, it is not the change people were hoping for.

The scam that is the most obvious is that being run by the US government. The stimulus bill that was passed by the government allows all of our tax dollars to be given away, proving to be the biggest scam the country has every run. It is important for people to begin understanding that we cannot continue to borrow against our children’s future. In order to put a stop to this, we need to vote these dishonest people out of office.

The problem lies in the fact that most people believe the government has access to unlimited funds, and have no true knowledge of how the economy really works. By continuing down the path we are following now, we will soon find out the spending more money is only multiplying our economy problems. Unfortunately, by the time most people figure this out, it will be too late to fix.

I Am For Con-Ass And Cha-Cha

February 24, 2010 at 6:49 am • Posted in PoliticsComments Off

The above, is a phrase I stand for but will surely bring about tons of criticism. However, before you give me a piece of your mind, allow me to give my reasons first. Basically, Con-Ass stands for Constitutional Assembly and Cha-Cha stands for Charter Change.

Charter Change is a term used to refer to the act of amending and revising the Constitution. Charter Change by way of Constitutional Assembly is an issue which that has caused so much misunderstanding between the masses and the Arroyo Administration.

The 1987 Philippine Constitution has outlined three ways of amending or revising our Constitution. The three are namely: 1.) By way of a Constitutional Assembly (Con-Ass) (Congress, upon a vote of three-fourths of all its Members) 2.) By a Constitutional convention (Con-Con) 3.) People’s Initiative

So now, why am for it when almost every body in the blogsphere are bashing on it? For me, making changes in our Constitution for the better is a good thing. Charter Change is the only viable way of putting those necessary changes. If we look at the US Constitution, we will find out that it’s last amendment was done on May 1992, which as raised the total amendments to 27 since its promulgation in 1787. Probably, one good change we can implement is reducing the population of Congressmen. They have become too many and too costly already. Another change could be including provisions that will be hinder political dynasties. There are more practical amendments that I could think of but I will be reserving those for another post.

Among the three methods of implementing Charter Change, Constitutional Assembly is the most efficient method. This is the reason why I am also for Con-Ass. Constitutional Convention not only costs a lot of money but so much time will be wasted. A people’s initiative is yet to be implemented and there has never been a law passed on how this should be exercised. Besides, it would also become very impractical should it be implemented. This leaves us with the Constitutional Assembly. Though it may sound ironic, we do still have intelligent lawmakers who can still produce very sensible amendments.

Well, so those are my reasons and opinion about why I am for Con-Ass and Cha-Cha. The reason why Con-Ass and Cha-Cha are very unpopular is because it has been oftentimes associated with Mrs. Arroyo’s supposedly schemes of remaining in office. This is very misleading and it deviates from the true reasons of Con-Ass and Cha-Cha. The public should bear in mind that Con-Ass and Cha-Cha are not only for such purpose.

But I am for Charter Change only after the May 2010 elections and Congress must do so. Going forward with Charter Change near the May 2010 elections would only lead to political chaos because of the misinformation that GMA is trying to extend her term of office. I am against Charter Change because Congress has been trying to implement such right now. Let Congress do Charter Change after the May 2010 elections.

Wedding Favours

February 23, 2010 at 11:38 am • Posted in PoliticsComments Off

There are many presents that can be used as wedding favours, after all the point of wedding favours is to show your guests that you are grateful for them coming to your wedding and showing their support for your wedding. Therefore, you should really try to find wedding favors, that your guests will be keen on.

Naturally, the gift that most suits your guests, may not be one you would pick for yourself, but you are getting the wedding favours for your guests, not yourself. If you think about it, you should be able to come up with something that everyone will like and that you are proud to give. In order to help you get the task done, we will offer you a few tips below.

Love spoons are a popular souvenir at Welsh and other Celtic weddings. A love spoon was a wooden spoon carved by a love sick man for the woman he loved. She would then either take or refuse the love spoon, although she was not obliged by the acceptance of the spoon. Miniature versions are often used as wedding favours. They can be inscribed with dates and names and symbols of love such as a hearts, bells, vines, key holes, anchors and knots.

Wedding favours can also be suitable to eat. There are a lot of choices available for couples who wish to give their guests some type of edible favour. You can have many items personalized these days. Some firms specialize in personalized presents, which can also be given as wedding favours. Some examples of edible, personalized wedding favours might be: chocolate bars, mints, biscuits or gourmet chocolates. The box or wrapper could bear your photo or / and your names and the date.

Small wedding cakes are another concept for edible wedding favours. Miniature wedding cakes have a short shelf life so they will have to include a warning, which will probably be put on the packaging automatically, but it is worth checking.

A half / quarter or miniature bottle of wine or other drink would also be fairly easy to arrange as wine bottle labels can be acquired in any home brew shop.

Picture frames are frequent wedding favors. You could give a picture frame and follow it up with a photo of the beneficiary of the frame enjoying your wedding reception. This might be costly and tricky to set up as you will have to keep records of who has been photographed and who has not. It would be dreadful to miss someone out, would it not? You will probably also need a professional photographer or at least a dedicated amateur.

Wedding favours can be anything really, but I reckon that they are best if they are useful. We gave very atypical bottle-openers away at our wedding. They had a pattern of a couple getting married, our names and the date. They also had a magnet in them to collect the bottle top as it came off. I have seen dozens of our bottle-openers stuck on our friends’ fridges over the years and the wedding was three years ago.
